These Terms and Conditions of Sale ("Terms") govern all purchases made through bynooka.com (the "Website"), operated by NOOKA ("we", "us", or "our"). By placing an order on our website, you agree to be bound by these Terms in their entirety. Please read them carefully before completing your purchase.

2. Products

NOOKA sells DIY miniature book nook kits with LED lighting (the "Products"). All Products are subject to availability. We reserve the right to modify or discontinue any product at any time without notice.

Product photos and descriptions are provided for informational purposes and are as accurate as possible. Minor variations in color or appearance may occur due to photography and screen calibration. These variations do not constitute grounds for a return or complaint.

3. Pricing and Payment

All prices are listed in US Dollars (USD). NOOKA reserves the right to change prices at any time. The price charged for an order is the price displayed at the time the order is placed.

Payment is due in full at the time of purchase. We accept all major credit and debit cards (Visa, Mastercard, American Express), PayPal, Apple Pay, Google Pay, and Shop Pay, as made available through our payment processor.

All transactions are processed securely through Shopify Payments or another certified payment gateway. NOOKA does not store credit card information.

4. Order Process and Confirmation

By placing an order on bynooka.com, you make an offer to purchase the selected Products at the stated price. Your order is confirmed when you receive an order confirmation email to the address provided at checkout.

NOOKA reserves the right to refuse or cancel any order at our sole discretion, including but not limited to cases involving suspected fraud, pricing errors, product unavailability, or failure to pass payment verification. In such cases, you will receive a full refund to your original payment method.

5. Shipping and Delivery

5.1 Shipping Zone NOOKA ships to all 50 states of the United States from our US-based warehouse. We do not currently ship internationally.

5.2 Delivery Times Standard delivery time is 5 to 10 business days from the date of shipment. These timeframes are estimates only and are not guaranteed. Delivery times may vary due to carrier delays, weather conditions, high-volume periods, or other circumstances beyond our control.

5.3 Shipping Costs Standard shipping rates apply as displayed at checkout. Orders over $80 qualify for free standard shipping to any address in the United States.

5.4 Tracking A tracking number will be provided by email once your order has shipped. NOOKA is not responsible for delays caused by the carrier once the package has been handed over for shipment.

5.5 Lost or Damaged Packages If your package is lost or arrives damaged, please contact us within 7 days of the expected delivery date at info@bynooka.com. We will work with you to resolve the issue promptly, including replacing the order or issuing a full refund at our discretion.

6. Returns and Refunds

6.1 Return Window You may return any unused, unassembled, and undamaged Product within 30 days of the delivery date for a full refund of the product price.

6.2 Return Conditions To be eligible for a return, the Product must be:

In its original, unopened or unassembled condition
In its original packaging
Free from damage caused by the customer

Products that have been partially or fully assembled, or that show signs of use, damage, or alteration by the customer, are not eligible for return.

6.3 Return Process To initiate a return, please email info@bynooka.com with your order number and reason for return. We will provide return shipping instructions within 2 business days. Return shipping costs are the responsibility of the customer unless the return is due to a defective or incorrect product.

6.4 Refund Processing Once your return is received and inspected, we will issue a refund to your original payment method within 5 to 10 business days. We will notify you by email when your refund has been processed.

6.5 Defective or Incorrect Products If you receive a defective, damaged, or incorrect product, please contact us at info @bynooka.com within 7 days of delivery. Include your order number and photos of the issue. We will ship a replacement at no cost or issue a full refund, including return shipping, at our discretion.

7. Order Cancellation

Orders may be cancelled free of charge before shipment. To cancel an order, contact info @bynooka.com immediately with your order number. Once an order has been shipped, it cannot be cancelled and the standard return policy applies.

8. Product Warranty

All NOOKA Products are covered by a limited warranty against manufacturing defects for a period of 30 days from the date of delivery. This warranty does not cover damage caused by misuse, accident, modification, or normal wear and tear.

To make a warranty claim, contact info @bynooka.com with your order number and a description and photographs of the defect. We will assess the claim and provide a replacement or refund at our sole discretion.

9. Privacy and Data Protection

NOOKA collects and processes personal data in accordance with our Privacy Policy, available at bynooka.com/policies/privacy-policy. By placing an order, you acknowledge that you have read and understood our Privacy Policy.

We use the personal data you provide solely to process your orders, manage your account, communicate about your purchases, and improve our services. We do not sell your personal data to third parties.

10. Limitation of Liability

To the fullest extent permitted by applicable law, NOOKA's total liability for any claim arising from or related to a purchase shall be limited to the total amount paid for the order in question.

NOOKA shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profits, loss of data, or loss of goodwill, even if advised of the possibility of such damages.

11. Modification of Terms

NOOKA reserves the right to modify these Terms at any time. Changes will be posted on this page with an updated date. Your continued use of the website following any changes constitutes your acceptance of the revised Terms.

12. Governing Law and Dispute Resolution

These Terms and Conditions of Sale are governed by and construed in accordance with the laws of the United States of America. Any dispute arising from or related to these Terms or any purchase made through bynooka.com shall be resolved through good-faith negotiation. If resolution cannot be reached, disputes shall be submitted to the competent courts of the United States.
